Pagio Terms of Use

Welcome to Pagio. Please read these terms carefully as they govern your use of our Judia AI assistant and private online library.

Acceptance of Terms

By accessing or using Pagio (“the Service”), an application with Judia AI, an assistant embedded in a personal online library, you agree to be bound by these Terms of Use and all applicable laws and regulations. These Terms apply to all users, including those on our free tier and paid subscription tier (R50.00 per month). If you do not agree with any part of these terms, you may not use our services.

Eligibility

You may use the Service only if you:

  • Are at least 15 years of age
  • Can form a binding contract with Pagio
  • Are not prohibited from using the Service under applicable law
  • Have not previously been suspended or removed from the Service

If you are between 15 and 18 years of age, you represent that you have obtained parental or guardian consent to use the Service.

Service Description

Pagio provides Judia, an AI assistant embedded in a personal online library. You may upload PDF documents to create your own private library and then chat with those documents using AI-powered question answering.

Your Library is Private

Your uploaded documents, chat history, and vector embeddings are visible ONLY to you.

  • No other user can see what documents you have uploaded
  • No other user can access your chat history or conversations
  • No other user can search your document content
  • No other user can view your document metadata (filenames, upload dates, page counts)
  • We do not have a “public profile” or “shared library” feature
  • We do not index your documents for search by other users

The only exceptions are: (1) legal requirement (court order/subpoena), (2) you voluntarily share your credentials or export your data, or (3) a security breach (we will notify you).

Note: Pagio reserves the right to modify, suspend, or discontinue any aspect of the Service at any time. However, we will never make your private library publicly visible without your explicit, written consent. Paid users will receive at least 30 days' notice of material changes affecting their subscription benefits.

Account Registration

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account
  • You may not use another user's account without their permission
  • Creating multiple free accounts to circumvent the 100-message monthly limit is prohibited and may result in termination of all associated accounts

Freemium Model & Subscription

Free Tier

  • 100 chat messages per calendar month – unused messages do not roll over
  • Up to 50 PDF documents in your library
  • 500 MB total storage space
  • 25 MB maximum file size per PDF
  • 200 pages maximum per PDF document
  • 14 days chat history retention

When you reach 100 messages, the chat feature will be disabled until the next month begins. You will receive notifications at 80%, 95%, and 100% usage.

Subscription Terms

  • Subscriptions are billed monthly in advance at R50.00 (including VAT where applicable)
  • Payments are automatically charged every 30 days using your selected payment method
  • You may cancel at any time – cancellation takes effect at the end of your current billing period
  • No refunds for partial months are provided
  • If payment fails, we will attempt to recharge after 3 days; after 7 days your account reverts to the free tier
  • Prices are subject to change with 30 days' notice to paid subscribers

Upgrade Anytime: Free tier users may upgrade to the paid tier at any time. Your chat messages counter resets immediately upon upgrading, and you gain access to all paid features right away.

User Content

You Retain Ownership

All PDF documents you upload to the Service remain your property. Pagio claims no intellectual property ownership over your content.

License to Pagio

By uploading content, you grant Pagio a limited, non-exclusive, royalty-free, worldwide license to:

  • Store, host, and back up your PDFs
  • Process, extract, chunk, and index your documents
  • Create and store vector embeddings
  • Use retrieved passages to generate chat responses
  • Display your document metadata (filename, upload date) in your library

This license exists solely to provide the RAG functionality and terminates automatically when you delete a document or close your account.

Your Warranties

You represent and warrant that:

  • You own the PDFs you upload or have obtained all necessary permissions
  • Your documents do not contain viruses, malware, or malicious code
  • Your documents do not violate any applicable laws or third-party rights
  • You will not upload content that is illegal, defamatory, obscene, or otherwise objectionable

Prohibited Activities

You agree NOT to:

  • Upload content that infringes on intellectual property rights (pirated books, unauthorized copies)
  • Upload documents containing child exploitation material (zero tolerance – reported to authorities)
  • Upload documents containing sensitive personal information (medical records, financial account numbers, government IDs)
  • Use automated means (bots, scrapers) to access the Service without permission
  • Attempt to reverse engineer the RAG engine, embedding algorithms, or retrieval logic
  • Use the Service to build a competing product
  • Engage in prompt injection attacks or attempts to manipulate the AI
  • Create multiple free accounts to exceed the 100-message monthly limit
  • Share your account credentials with others
  • Violate any applicable laws or regulations

Termination

Termination by You

You may terminate your account at any time through account settings or by emailing us. Upon termination, your right to use the Service ceases immediately.

Termination by Pagio for Cause

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms, engage in prohibited activities, or exceed free tier limits through abuse.

Termination for Inactivity (Free Tier Only)

If your free tier account remains inactive for 6 consecutive months, we will send a warning email. If no action is taken within 30 days, your account and all associated data will be permanently deleted.

Effect of Termination

Upon termination, all documents, chat history, and vector embeddings are permanently deleted from active storage within 7 days and from backups within 30 days. No refunds are provided for paid subscriptions.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PAGIO DISCLAIMS ALL WARRANTIES, INCLUDING:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, timely, secure, or error-free
  • Warranties that AI-generated responses will be accurate, complete, or reliable
  • Warranties that documents will be processed correctly

Judia (AI assistant) Specific Disclaimer: The AI-powered chat feature may produce inaccurate, hallucinated (made-up), incomplete, or misleading responses. You are solely responsible for verifying any information generated by the Service. Do not rely on the Service for medical diagnosis, legal advice, financial decisions, or safety-critical applications.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

No Consequential Damages: IN NO EVENT SHALL PAGIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Total Liability Cap: PAGIO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL BE LIMITED TO THE GREATER OF ZAR 100 OR THE AMOUNT YOU PAID TO PAGIO IN THE 6 MONTHS PRECEDING THE CLAIM.

For free tier users, this means Pagio's total liability is ZAR 100.

Indemnification

You agree to indemnify and hold harmless Pagio from any claims, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by the laws of the Republic of South Africa.

Dispute Resolution: Disputes shall first be attempted to be resolved informally through pagio.app@gmail.com. If unresolved, disputes shall be resolved through binding arbitration administered by the Arbitration Foundation of Southern Africa (AFSA) in Johannesburg, South Africa.

No Class Actions: You agree to resolve disputes on an individual basis and waive the right to participate in any class action.

Changes to These Terms

We may modify these Terms at any time. Material changes will be notified by email (paid users) or in-app notification (all users). Changes become effective 30 days after notice for existing users. Your continued use constitutes acceptance.

This document constitutes the entire agreement between you and Pagio regarding the Service. If any provision is found to be invalid, the remaining provisions remain in full force and effect. These Terms incorporate our Privacy Policy, Cookie Policy, GDPR Addendum, POPIA Compliance section, and Copyright Policy by reference.
